The action questions part of article 3 of Portugal Mobile Number List Law 12,996/2014, which provides that interstate and international passenger transport services can be operated upon authorization, without the need for bidding. It also contests part of resolution 71 of August this year, and several articles of Deliberation 955/2019, published by the National Land Transport Agency (ANTT), at the end of October.
The new standards, implemented this year, bring principles such as free competition, freedom of prices, itinerary and frequency.
However, the entity representing the sector questions the changes, and claims that the complete opening of the market to the private sector removes several rights from users, including the minimum frequency of itineraries, renewal of the vehicle fleet regularly and control over price. of the tariff.
Anatrip argues that the Executive invaded the Legislative's competence with the decrees. "The regulation of matters relating to the interstate transport of passengers must, as a rule, be dealt with by law, in the strictest sense, within the scope of the Union, which, consequently, imposes restrictions on the other Powers, notably the Executive, to deal with the matter , since it carries out public policies according to the precepts established by the Legislative Branch, and not the other way around", he states.
"CPPI and ANTT's claim that the "market regulates or accommodates" all situations, in the case of public service, is not correct because if there is freedom of operation, carriers will choose to explore the most economically promising markets, causing an abandonment of several locations currently served by the model that is in force", he concludes.
